These Terms of Service ("Terms") govern the use of the Tonus+ mobile application ("the App"), published by PandaSoft SASU ("the Publisher").

By using the App, you agree to these Terms in their entirety.

1. Purpose of the App

Tonus+ is a fitness application designed for seniors. It offers exercise programs, mood tracking, a gamification system, and scheduling tools.

Tonus+ does not constitute medical advice. The App is not a substitute for consulting a healthcare professional.

2. Medical disclaimer

Consult your doctor before starting any exercise program, especially if you have health conditions, chronic pain, or are taking medication.

The Publisher disclaims all liability for any injury or health issue occurring during or after use of the App. You exercise at your own risk.

If you experience pain, shortness of breath, or feel unwell during an exercise, stop immediately and consult a doctor.

3. Account creation

To use the App, you must create an account with a valid email address or sign in with Google.

You are responsible for keeping your login credentials confidential.

4. Free and premium content

The App offers free content (Level 1 exercises, selected articles) and premium content accessible through a paid subscription.

Available subscriptions:

  • Monthly — automatic renewal each month
  • Annual — automatic renewal each year
  • Lifetime — one-time payment, permanent access

Payment and renewal:

  • Payments are processed by Apple (App Store) or Google (Google Play)
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
  • Subscription management and cancellation are handled through your Apple or Google account settings

Restore purchases:

You can restore your previous purchases at any time from the subscription screen in the App.

5. Intellectual property

All content in the App (text, images, exercises, design, code) is the exclusive property of PandaSoft SASU.

Any unauthorized reproduction, modification, or distribution is prohibited.

6. Personal data

The collection and processing of your personal data are governed by our Privacy Policy.

7. Emergency contact

The App allows you to save an emergency contact. This feature is provided as an aid and does not guarantee assistance in case of a medical emergency.

In case of a life-threatening emergency, call 911 (US), 999 (UK), or 112 (EU).

8. Availability

The Publisher strives to keep the App accessible at all times but does not guarantee uninterrupted availability. Maintenance interruptions may occur.

9. Limitation of liability

The Publisher shall not be held liable for:

  • Damages resulting from the use of or inability to use the App
  • Injuries occurring during the practice of proposed exercises
  • Data loss due to technical failure
  • Content or services provided by third parties (external links, recommended products)

10. Changes to these Terms

The Publisher reserves the right to modify these Terms at any time. Users will be notified of any changes through the App.

11. Governing law

These Terms are governed by French law. Any dispute shall be submitted to the competent courts within the jurisdiction of the Publisher's registered office.
